These Terms and Conditions ("Terms") govern your access to and use of the website located at www.myvisaacademy.com.au (the "Website") and any online courses, videos, guides, checklists, downloads and other educational materials made available through it (together, the "Course Materials"), operated by My Visa Academy Limited, a company incorporated in New Zealand.
By accessing the Website, creating an account, or purchasing any Course Materials, you agree to these Terms. If you do not agree, do not use the Website or purchase Course Materials.
1. WHAT MVA IS AND WHAT IT IS NOT
1.1 MVA is an online education provider only. MVA publishes general educational content explaining how Australian visa processes work.
1.2 MVA is not, and does not hold itself out as:
(a) a law firm, legal practice or incorporated legal practice;
(b) a registered migration agency, or a registered migration agent;
(c) a migration, immigration or visa consultancy;
(d) a provider of immigration assistance within the meaning of section 276 of the Migration Act 1958 (Cth);
(e) a provider of legal services within the meaning of the Legal Profession Uniform Law or any equivalent legislation in any Australian state or territory, New Zealand, or elsewhere.
1.3 MVA does not, under any circumstances:
(a) provide legal advice, migration advice, immigration advice or immigration assistance;
(b) advise on, assess, or comment on any individual's circumstances, eligibility, prospects or options;
(c) prepare, draft, complete, review, check, audit or lodge any visa application, form, statement, submission or supporting document for any person;
(d) represent any person before the Department of Home Affairs, the Administrative Review Tribunal, any court, or any other body;
(e) recommend whether any person should apply for any visa, or which visa any person should apply for;
(f) guarantee, predict or influence the outcome of any visa application.
1.4 The Course Materials are general educational publications. They are prepared without knowledge of, and without reference to, the circumstances of any individual. They are the educational equivalent of a published book: identical for every purchaser and applied to no purchaser's individual case by MVA.
1.4A Educational Publications Only
The Course Materials are educational publications only. They are informational and educational resources designed to explain visa processes, systems, procedures and concepts in a general manner.
The Course Materials are not legal services, migration services, immigration assistance, advisory services, consulting services, professional services, representation services, application preparation services, decision-making tools, eligibility assessment tools, recommendation systems or personalised guidance of any kind.
The Course Materials are published in substantially the same form for all users and are not created, adapted, modified or delivered by reference to any user's individual circumstances.
Users acknowledge and agree that the Course Materials are purchased as educational publications only, and not as a substitute for professional advice, representation or services relating to any individual matter.
1.5 Any statement on the Website or in the Course Materials that course content was authored, written, designed or created by an immigration lawyer is a description of the authorship of educational content only. It does not mean, and must not be taken to mean, that any lawyer acts for you, is available to advise you, has considered your circumstances, or has any professional relationship with you.
1.6 Some Course Materials and promotional content may feature a presenter delivered through an artificial intelligence generated avatar. Where an avatar depicts a real person, it is used with that person's consent and presents a digital likeness and synthesised voice rather than a live recording, photograph, video recording, audio recording, real-time appearance or personal presentation by that person.
Any credential, qualification, professional title, experience or biographical information attributed to that person is true and is referenced solely to describe the authorship, creation, expertise or educational basis of the Course Materials.
Users acknowledge and agree that any such avatar is a digital recreation and does not represent, imply or indicate that the person depicted personally recorded, filmed, narrated, presented, delivered, appeared in, supervised, reviewed or otherwise participated in the creation of any particular video, lesson, advertisement, promotional content or communication in which the avatar appears.
Users further acknowledge and agree that the appearance, voice, likeness, mannerisms, expressions and presentation style of any avatar are part of an artificial intelligence generated representation and must not be relied upon as evidence that any content was personally filmed, recorded or presented by the person depicted.
The use of an avatar is for educational, illustrative, branding and content delivery purposes only. It does not alter the educational nature of the content, does not constitute legal advice, migration advice or immigration assistance, does not mean that any person depicted acts for you or is available to advise you, and does not create any solicitor-client, lawyer-client, migration adviser-client, agency, fiduciary, employment, representative or other professional relationship of any kind.
To the maximum extent permitted by law, no representation is made that any avatar appearance constitutes a live appearance, personal recording or direct communication from the person depicted.
2. NO PROFESSIONAL RELATIONSHIP
2.1 Nothing in your use of the Website, your purchase of Course Materials, your communications with MVA or its personnel, or your completion of any course creates:
(a) a solicitor-client or lawyer-client relationship;
(b) an agent-client relationship;
(c) a fiduciary relationship;
(d) a retainer of any kind; or
(e) any relationship of adviser and advisee, between you and MVA, or between you and any author, presenter, contractor, employee or officer of MVA.
2.2 No communication from MVA (including support responses, emails, social media replies, comments, or automated messages) constitutes advice about your circumstances, and no such communication is to be relied upon as advice. MVA's support function is limited to course access, billing and technical matters.
3. YOUR ACKNOWLEDGEMENTS
By purchasing or using any Course Materials, you expressly acknowledge and agree that:
3.1 you are purchasing access to general educational content, not any service relating to your own visa application;
3.2 you are solely responsible for your own visa application, including every decision about whether to apply, which visa to apply for, when to lodge, what to write, what evidence to gather and submit, and how to respond to any request or decision;
3.3 MVA has no knowledge of your circumstances and the Course Materials have not been, and will not be, tailored to them;
3.4 the Course Materials explain how processes work in general, and how any process applies to your circumstances may differ;
3.5 visa requirements, fees, forms, policies and processes change. The Course Materials reflect MVA's understanding at the time of production, and you must verify all current requirements against official sources, including the Department of Home Affairs website and the current legislation, before acting;
3.5A Regulatory and Policy Changes
Immigration laws, regulations, legislative instruments, policies, procedures, forms, evidentiary requirements, government fees, processing practices and administrative approaches may change at any time without notice.
MVA does not represent, warrant or guarantee that any Course Materials will reflect every change immediately or within any particular timeframe after such changes occur.
While MVA may update, revise or replace Course Materials from time to time, MVA is under no obligation to update any Course Materials within any specified period following any legislative, regulatory, policy or procedural change.
Users are solely responsible for verifying all current requirements against official government sources and applicable legislation before acting on any information contained in the Course Materials.
3.6 visa outcomes are determined solely by the relevant government decision-maker. Nothing in the Course Materials is a representation, prediction or guarantee about the outcome of any application;
3.6A No Outcome Representations
MVA does not represent, warrant, guarantee or imply that any Course Materials will:
(a) result in the approval, grant or success of any visa application;
(b) improve, maximise or increase the prospects of any visa application;
(c) reduce the likelihood of refusal, cancellation, delay, further information requests, investigation or review;
(d) reduce processing times or accelerate any government decision;
(e) identify the most suitable visa pathway for any individual; or
(f) achieve any particular outcome, benefit or result for any user.
Any visa outcome depends on the individual circumstances of the applicant, the evidence provided, applicable law and policy, and the decisions of the relevant government authority. All visa decisions are made solely by the relevant government authority and are entirely outside MVA's control.
Users acknowledge that they have not purchased the Course Materials in reliance on any representation, promise or expectation of any particular visa outcome.
3.6B Testimonials, Reviews and Examples
Any testimonial, review, endorsement, comment, rating, case study, example, success story or user experience published by MVA is provided for general informational purposes only.
Testimonials, reviews and examples reflect the individual experiences, opinions and circumstances of the relevant person and are not intended to represent, predict, warrant or guarantee that any other person will achieve the same or similar outcome.
Individual experiences may vary significantly depending on personal circumstances, eligibility requirements, evidence, government policies, applicable law and the decisions of relevant government authorities.
Users acknowledge and agree that they have not relied upon any testimonial, review, endorsement, case study, example or success story as a representation, prediction or guarantee of any particular outcome, result or benefit from the Course Materials.
3.7 teaching examples, worked illustrations and sample structures in the Course Materials are fictional and illustrative only. They are provided to teach reasoning and standards. They are not templates and must not be copied, adapted or reproduced into any application, statement or document you submit to any government body;
3.8 if your circumstances are complex, unusual, urgent or high-risk, or if you require advice about your own situation, you should obtain advice from a registered migration agent or an Australian legal practitioner (or the equivalent qualified professional in your jurisdiction) before acting;
3.9 you have not relied, and will not rely, on any statement by MVA outside these Terms and the published descriptions of the Course Materials in deciding to purchase; and except as expressly set out in these Terms and the published description of the relevant Course Materials at the time of purchase, you acknowledge and agree that you have not relied upon, and will not rely upon, any statement, representation, promise, expectation, opinion, estimate, projection or other communication made by or on behalf of MVA.
Without limitation, this includes any statement appearing in advertisements, promotional materials, social media content, videos, webinars, interviews, articles, emails, testimonials, reviews, comments, demonstrations, examples, case studies, sales pages, landing pages or other marketing content.
You acknowledge that all such material is general in nature and must be read subject to these Terms and the published description of the relevant Course Materials. No such material constitutes legal advice, migration advice, immigration assistance, a guarantee of any outcome, or a promise regarding the suitability, usefulness or outcome of any Course Materials for your particular circumstances.
3.10 your purchase decision was not induced by any representation that MVA would provide advice, assistance, review, preparation or representation of any kind.
4. ELIGIBILITY TO PURCHASE AND ACCOUNTS
4.1 You must be at least 18 years old and capable of entering a binding contract to purchase Course Materials.
4.2 You must provide accurate account and payment information and keep your login credentials confidential. You are responsible for all activity under your account.
4.3 Accounts and course access are personal to you. You must not share, sell, lend or transfer your account or access to any other person.
5. LICENCE AND INTELLECTUAL PROPERTY
5.1 All Course Materials, and all content on the Website, including videos, scripts, text, PDFs, checklists, graphics, branding and course structure, are owned by or licensed to MVA and are protected by copyright and other intellectual property laws.
5.2 On purchase, MVA grants you a personal, non-exclusive, non-transferable, revocable licence to access and view the Course Materials for your own personal, non-commercial education, for the access period stated on the relevant product page.
5.3 You must not, except as expressly permitted:
(a) copy, download (other than downloads MVA expressly provides), record, screen-capture, scrape or extract any Course Materials;
(b) share, publish, distribute, broadcast, resell, sublicense or otherwise make Course Materials available to any third party;
(c) use any Course Materials to provide, or to support the provision of, advice, assistance or services to any other person, whether paid or unpaid;
(d) use any Course Materials, in whole or in part, to train, fine-tune, augment, improve, test, evaluate or develop any artificial intelligence, machine learning, large language model, neural network, recommendation system, automated decision-making system or similar technology;
(e) use any Course Materials for data mining, text and data extraction, scraping, harvesting, indexing, knowledge extraction, synthetic dataset creation, retrieval-augmented generation (RAG), embedding generation, vectorisation, model evaluation, model benchmarking or any substantially similar activity;
(f) input, upload, transmit or make available any Course Materials to any artificial intelligence platform, generative AI system, chatbot, language model or automated content generation system for the purpose of reproducing, summarising, analysing, transforming, generating derivative works from or otherwise exploiting the Course Materials;
(g) use any Course Materials to create, develop, teach, publish, distribute or commercialise any competing course, educational product, training program, knowledge base, advisory system or similar product or service.
5.4 Breach of this clause is grounds for immediate termination of access without refund, in addition to any other rights MVA may have, subject always to clause 9.
6. ACCESS, CHANGES AND AVAILABILITY
6.1 The access period, inclusions and any update entitlement for each course are stated on the relevant product page, which forms part of these Terms for that purchase.
6.2 MVA may update, correct, restructure, add to or remove content from the Course Materials at any time, including to reflect changes in law, policy or process. MVA may retire a course, in which case existing purchasers will retain access for the remainder of their stated access period or be offered a substantially equivalent alternative.
6.3 MVA will use reasonable efforts to keep the Website and Course Materials available, but does not promise uninterrupted or error-free availability. Hosting is provided through third-party platforms, and outages outside MVA's reasonable control may occur.
7. PRICE AND PAYMENT
7.1 Prices are as displayed at checkout, in the currency displayed, and may change at any time prior to purchase. Price changes do not affect completed purchases.
7.2 Payment is processed by third-party payment providers. MVA does not store full payment card details.
7.3 Any comparisons on the Website between the price of Course Materials and professional fees charged by law firms or migration agents are general illustrations of typical market fees charged by third parties for professional services. They are not, and are not represented to be, a former price of the Course Materials.
8. REFUNDS AND CONSUMER GUARANTEES
This clause is MVA's complete refund policy.
8.1 Nature of the product. Course Materials are digital educational content delivered by immediate online access. Once access is granted, the product is capable of being consumed in full, and the knowledge it delivers cannot be returned.
8.2 Change of mind. No refund is provided for change of mind, for deciding not to proceed with a visa application, for engaging a lawyer or migration agent instead, for purchasing the wrong course where the product page accurately described the course, or because requirements applicable to you changed after purchase. You are responsible for reading the product page, the course inclusions and these Terms before purchasing.
8.3 Duplicate purchases and billing errors. MVA will refund in full any duplicate purchase of the same course on the same or a commonly controlled account, and will correct and refund any amount charged in error.
8.4 Inability to access. If a technical fault attributable to MVA or its hosting platform prevents you from accessing purchased Course Materials, and MVA cannot restore your access within a reasonable time after you notify support at support@myvisaacademy.com, you are entitled to a refund of the affected purchase.
8.5 What is not a defect. Without limiting clause 8.7, the following are not failures or defects in the Course Materials: that the content is general and not tailored to your circumstances (that is the product, as stated throughout these Terms); that your visa application was refused, delayed or otherwise unsuccessful; that government requirements, fees, forms or processes changed after the content was produced; that you found some content already familiar to you; or your level of satisfaction with the difficulty, length or style of the content where the product page accurately described it.
8.6 Consumer guarantees preserved. Nothing in these Terms, including this clause 8, excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) for consumers in Australia, and the Consumer Guarantees Act 1993 (NZ) and Fair Trading Act 1986 (NZ) for consumers in New Zealand. If the Course Materials fail to comply with an applicable consumer guarantee, you are entitled to the remedies that law provides, which may include repair, replacement, resupply or refund depending on whether the failure is major or minor. This clause 8 operates in addition to, and not instead of, those rights.
8.7 How to request a refund. Email support@myvisaacademy.com from the email address on your account with your order number and the basis of the request under this clause. MVA will respond within 5 business days. Do not include your visa circumstances, application details or documents in any refund request; refund decisions are made on the purchase and access records, never on the merits of any visa matter.
8.8 Method and timing. Approved refunds are processed to the original payment method within 10 business days of approval. Where a refund is granted, your access to the relevant Course Materials ends on processing of the refund.
8.8A Payment Disputes and Chargebacks
Before initiating any chargeback, payment dispute, reversal request or similar claim with a payment provider, card issuer, bank or financial institution, you agree to first contact MVA at support@myvisaacademy.com and provide reasonable details of the issue.
MVA will be given a reasonable opportunity to investigate and, where appropriate, resolve the issue in accordance with these Terms and applicable consumer laws.
Nothing in this clause limits any right or remedy that cannot lawfully be excluded or restricted.
9. LIABILITY
9.1 The Course Materials are educational publications only. They are not legal services, migration services, immigration assistance, consulting services, advisory services, representation services or professional services of any kind. Users assume all responsibility and risk associated with their access to, use of, reliance upon and application of the Course Materials.
9.2 To the maximum extent permitted by law, MVA excludes all liability, whether arising in contract, tort (including negligence), equity, statute, consumer protection legislation, misrepresentation, restitution or otherwise, for any loss, damage, liability, cost, expense, claim or proceeding arising directly or indirectly out of or in connection with:
(a) the Website or any Marketing Content or Course Materials;
(b) any use of, reliance upon, interpretation of or application of any Marketing Content or Course Materials;
(c) any visa application, immigration process, government process, review, appeal, investigation or decision;
(d) any act, omission, decision, judgment, assessment, submission, statement or communication made by you;
(e) any inaccuracy, omission, error, outdated information or incomplete information in any Course Materials;
(f) any change in legislation, regulations, policies, procedures, forms, evidentiary requirements, fees, government practices or administrative approaches;
(g) any inability to access the Website or Course Materials;
(h) any third-party platform, payment processor, hosting provider, software provider or external service;
(i) any reliance upon testimonials, examples, case studies, reviews, educational illustrations or marketing materials; or
(j) any matter arising from or connected with a user's individual circumstances.
9.3 Without limiting clause 9.2, MVA is not liable for any:
(a) visa refusal, cancellation, delay, investigation, review, appeal or adverse decision;
(b) loss of application fees, government charges, professional fees, travel costs, relocation costs, accommodation costs or other expenses;
(c) loss of opportunity, loss of income, loss of earnings, loss of profits, loss of business, loss of contracts, loss of goodwill, loss of reputation, loss of data or loss of anticipated savings; or
(d) indirect, consequential, incidental, exemplary, special or punitive loss or damage,
whether foreseeable or unforeseeable and whether or not MVA was advised of the possibility of such loss.
9.4 To the maximum extent permitted by law, and except where liability cannot lawfully be excluded or limited, MVA's total aggregate liability arising out of or in connection with the Website, the Marketing Content or Course Materials, these Terms or any claim between the parties is limited to the lesser of:
(a) the amount paid by you to MVA for the specific Course Materials giving rise to the claim; and
(b) the cost of resupplying those Course Materials.
9.5 If any liability cannot lawfully be excluded but can be limited, MVA's liability is limited to the fullest extent permitted by applicable law.
9.6 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.
9.7 You acknowledge and agree that:
(a) the Course Materials are provided at a price substantially lower than the cost of professional legal, migration or consulting services;
(b) MVA has no knowledge of your circumstances and assumes no responsibility for any decision made by you;
(c) you bear sole responsibility for all actions taken by you in connection with any visa application or government process; and
(d) the exclusions and limitations in this clause are fair, reasonable and form an essential basis of the agreement between you and MVA.
10. YOUR CONDUCT
10.1 You must not:
(a) submit your personal circumstances, application documents or case details to MVA, or request advice, assessment, review or assistance from MVA, whether through support channels, social media, email or otherwise. MVA will decline all such requests;
(b) use the Website or Course Materials for any unlawful purpose, or to provide unregistered immigration assistance or unqualified legal services to any person;
(c) misrepresent any affiliation between yourself and MVA; or
(d) interfere with the security or operation of the Website.
10.2 MVA may suspend, restrict or terminate your access to the Website and any Course Materials immediately if MVA reasonably believes that you have breached these Terms, engaged in unauthorised use of the Course Materials, infringed MVA's intellectual property rights, shared access with another person, or otherwise acted in a manner inconsistent with these Terms.
10.3 Upon suspension or termination:
(a) all rights granted to you under these Terms immediately cease;
(b) you must immediately stop accessing, using, reproducing, distributing, sharing or otherwise exploiting any Course Materials;
(c) MVA may disable or remove your access to the Website, your account and any Course Materials without further notice; and
(d) termination or suspension does not entitle you to any refund except to the extent required by applicable law.
10.4 Suspension or termination of access does not affect any rights, remedies, obligations or liabilities that accrued before the suspension or termination, including any rights relating to intellectual property infringement, misuse of Course Materials or breach of these Terms.
11. THIRD-PARTY CONTENT AND OFFICIAL SOURCES
11.1 The Website and Course Materials may reference or link to third-party websites, including the Department of Home Affairs. MVA does not control and is not responsible for third-party content.
11.2 Official government sources prevail over the Course Materials in every case of difference. You must rely on official sources for current requirements, fees, forms and processes.
12. PRIVACY
12.1 MVA collects only the personal information reasonably required to operate user accounts, process purchases, provide course access and administer the Website, and handles that information in accordance with its Privacy Policy available at https://www.myvisaacademy.com.au/legal-pages/privacy-policy.
MVA does not request, and you must not submit, passports, identity documents, visa application documents, supporting evidence, personal case files or other materials relating to your individual immigration matter.
13. INDEMNITY
13.1 To the maximum extent permitted by law, you indemnify and hold harmless MVA, its directors, officers, employees, contractors, authors, presenters, licensors, affiliates and related entities from and against any and all loss, liability, damage, cost, expense, claim, demand, action, proceeding, investigation, complaint, inquiry, penalty, fine or legal expense (including legal costs on a full indemnity basis) arising directly or indirectly out of, relating to, connected with, or resulting from:
(a) your access to, use of, misuse of, reliance upon or application of any Course Materials;
(b) any decision, action, omission, submission, statement, representation, application, document, evidence, communication or conduct by you;
(c) any visa application, immigration process, government process, review, appeal, request, investigation, proceeding or decision involving you;
(d) any use made by you of information, concepts, examples, explanations, illustrations, strategies, techniques, methods, processes or educational content contained within the Course Materials;
(e) any allegation that MVA provided you with legal advice, migration advice, immigration assistance, professional services, representation, recommendations or personalised guidance;
(f) any complaint, report, inquiry, investigation, proceeding or action involving any government authority, regulator, law society, professional body, consumer protection authority, migration regulator or similar organisation arising from your conduct, actions, omissions, statements or dealings;
(g) any claim by any third party arising from or connected with your use of, reliance upon, interpretation of or application of the Course Materials;
(h) your breach of these Terms; or
(i) any unlawful, unauthorised or improper use of the Website or Course Materials.
13.2 The indemnity in this clause applies regardless of whether the relevant claim, complaint, investigation or proceeding is brought by you, a third party, a government authority, a regulator or any other person.
13.3 The indemnities in this clause are continuing obligations, survive termination of these Terms, and are not limited by any other provision of these Terms.
14. CHANGES TO THESE TERMS
14.1 MVA may update these Terms from time to time. The version published on the Website at the time of your purchase applies to that purchase. Continued use of the Website after changes are published constitutes acceptance of the updated Terms for future use and purchases.
15. GENERAL
15.1 Entire agreement. These Terms, together with the relevant product page, the published refund policy and the Privacy Policy, constitute the entire agreement between you and MVA regarding the Website and Course Materials, and supersede all prior representations.
15.2 Severability. If any provision is invalid or unenforceable in any jurisdiction, it is severed in that jurisdiction to the extent of the invalidity, and the remainder of these Terms continues in force.
15.3 No waiver. A failure by MVA to enforce any provision is not a waiver.
15.4 Assignment. You may not assign your rights under these Terms. MVA may assign its rights and obligations to a related entity or a purchaser of its business on notice.
15.5 Force majeure. MVA is not liable for failure or delay caused by events beyond its reasonable control.
15.6 Governing law and jurisdiction. These Terms are governed by the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the courts of New Zealand.
15.7 Interpretation. Headings are for convenience only. "Including" means "including without limitation."
15.8 Survival
Clauses 1, 2, 3, 5, 8, 9, 10, 13 and any other provision which by its nature is intended to survive termination or expiry of these Terms survive termination, suspension or expiry of these Terms.

Nothing offered by My Visa Academy constitutes legal advice, immigration assistance, or advice tailored to any individual's circumstances. We do not prepare, lodge, review, or advise on any individual's visa application, and we do not act for any person in relation to any application, review, or proceeding. You remain solely responsible for your own visa application and any decisions you make.
